ORDINANCE NO. 208 an ordinance amending Chapter 32 of the Dunes City Code of Ordinances regarding Members;
Qualifications and Meeting; Quorum of the CITY OF WHEREAS, on August 8, 1996, the City Council of Dunes City adopted Ordinance No. 149, an ordinance establishing a Road Commission, defining duties and responsibilities; establishing terms of office,
and general procedures; and declaring an emergency; and WHEREAS, the City Council of Dunes City desires to modify the Chapter 32.42 Members; Qualifications
and Chapter 32.46 Meetings; Quorum to be more consistent with the operation of other Dunes City commissions and committees. NOW THE Section 1. Chapter 32.42 of the Code of Dunes City is modified to read as follows: (A)
Number of members. The Commission shall consist of seven members; one City Council member who acts as the Road Commission Chairperson who votes only when a tie occurs, five voting
members appointed by City Council who shall not be employees of nor officials for the City, and the City’s Director of Roads who shall be an ex-officio, non-voting member of the Road Commission. (B)
Qualifications. All members of the Road Commission must be legal residents of (C)
Vice-Chair Election. At the first meeting of each odd-numbered year, or as needed due to vacancy, the Road Commission shall elect a Vice-Chair from among its five voting members. When
acting as chairperson, the Vice-Chair forgoes their normal voting rights and assumes the rights, duties, and limitations of the chairperson as outlined in chapter 32.46. Section 2. Chapter 32.46 of the Code of Dunes City is modified to read as follows: (A) Meetings; quorum. The Road Commission should meet at least once each month and shall meet on the call of the Chairperson or on call by a majority of its members. In the absence of the
Chairperson, the elected Vice-Chair shall preside over the meeting. In the Road Commission Chairperson’s absence, if the elected Vice-Chair is not present, City Council may appoint an acting chair
as allowed by law. When acting as Chairperson, the Vice-Chair or other designee shall only exercise their vote if a tie vote occurs. Minutes shall be taken of meetings and are to include the meeting
date, members present, items discussed, citizen input, matters voted upon by the members, and recommendations to the City Council. Minutes shall be presented in the form of the Road Commissioner’s
report to the City Council at its next regularly scheduled meeting. (B) Quorum. A majority of voting members shall constitute a quorum. The Road Commission Chairperson, or any acting chairperson, such as the elected Vice-Chair, or other appointee as allowed by law, shall only be considered a voting member for the purposes of establishing a quorum, as their voting rights are only exercised if a tie vote occurs.
