ORDINANCE NO. 205 AN ORDINANCE REPEALING ORDINANCES 187 AND 191 AND AMENDING CHAPTER 32 OF THE CODE OF DUNES CITY REGARDING OPERATION OF THE DUNES CITY PLANNING COMMISSION; AND DECLARING AN EMERGENCY CITY OF WHEREAS, the Dunes City Council is interested in modifying the general procedures regarding the operation of the Dunes City
Planning Commission. NOW THE Section 1. Ordinance Nos. 187 and 191 are hereby repealed, effective on the date this Ordinance takes
effect. Section 2. Section 32.61 (A) of the Code of Dunes City, is modified to read: (A) The Commission shall consist of five voting members and a chair that votes only when a tie occurs, each of whom shall be a resident of the city and appointed by the Council. Section 3. Section 32.61 of the Code of Dunes City, is amended by the addition of a Subsection (D): (D) Four members of the Commission shall constitute a
quorum. Section 4. Section 32.62 (B) of the Code of Dunes City, is modified to read: (B) The Commission shall select from its membership a
Chairperson and Vice-Chairperson to serve for one-year terms. No member shall be eligible for more than two consecutive terms as Chairperson or Vice-Chairperson. The Chairperson, or the
Vice-Chairperson if acting as chair, shall vote only when a tie occurs. Section 5. Section 32.63 of the Code
of Dunes City, is modified to read: A term of office on the Commission shall be three
years. The terms of Commission members shall be staggered so that two positions shall become open every third year. The term of office shall commence on January 1 and expire on December 31. Section 6. Section 32.71 of the Code of Dunes City, is modified to read: The Commission shall complete its action on all land
use applications coming before it within 60 days of the application being deemed complete, unless a longer time for the city to take final action on the application is requested in writing by the
applicant. The Commission shall complete its action on all other requests within 60 days of the filing thereof, unless a shorter time is provided by order or ordinance. Section 7. Emergency Clause. This
Ordinance, being necessary for the public health, safety, and welfare of the City of Dunes City, an emergency is hereby declared to exist and this Ordinance shall become effective on the date adopted
