1.     Call to order       

Mayor Eric Hauptman called the special session of the Dunes City Council to order at 4:00 pm .  

2.     Roll call  

Roll Call was taken by Fred Hilden, City Recorder .  

Present:    Mayor Eric Hauptman, Council President Rebecca Ruede , Councilor Richard Anderson, Councilor Richard Koehler , Councilor Troy Sathe, and Councilor Duke Wells.  

Absent:     Councilor Jamie Mills (excused).  

Also Present:        City Recorder Fred Hilden and City Attorney Carrie Connelly of Local Government Law Group PC (via telephone), and one citizen.  

3.     Pledge of Allegiance  

All who were present stood for the Pledge of Allegiance.

4.     Approval of the agenda  

Councilor Sathe made the motion to approve the Agenda.  The motion was seconded by Councilor Wells.  The motion passed by unanimous vote.  

5.     Consent agenda - None  

6.     Announcements / Correspondence - None  

7.     Executive Session  

·        Called under ORS 192.660 (2) (h) to consult with legal counsel concerning the legal rights and duties of the City with regard to the Montgomery litigation.  

Mayor Hauptman called for a recess at 4:10 pm and the City Council entered into Executive Session.  

Mayor Hauptman reconvened the Special Session of the City Council at 5:38 pm .  

Councilor Ruede made the motion that the Council directs the City Recorder to contact the City's engineering firm to clarify the Planning Commission's recommendations and conditions of approval for the Montgomery preliminary plat.  Councilor Wells seconded the motion.  

Mayor Hauptman stated that Councilor Sathe just recused himself from this meeting and is now sitting in the audience.   

The motion made by Councilor Ruede that the Council directs the City Recorder to contact the City's engineering firm to clarify the Planning Commission's recommendations and conditions of approval for the Montgomery preliminary plat passed by unanimous vote.  

Councilor Ruede made the motion that the City contacts Mr. Alan Montgomery as to the City's plans to move forward in discussions of his planned development.  The motion was seconded by Councilor Wells.  The motion passed by unanimous vote.

There being no further business to come before the City Council, Councilor Koehler made the motion to adjourn the meeting.  Councilor Wells seconded the motion.  The motion passed by unanimous vote.  

The meeting of the Dunes City Council Special Session adjourned at 5:55 pm .
