1.  Call to order and roll call  

Mayor Eric Hauptman called the meeting of the Dunes City Council to order at 7:08 p.m.  

2.  Roll call  

Roll Call was taken by Fred Hilden, City Recorder.  

Present:              Mayor Eric Hauptman, Council President Peter Howison, Councilor Richard Koehler, Councilor Jamie Mills, Councilor Susie Navetta, Councilor Rebecca Ruede, and Councilor Troy Sathe.  

Absent:  None  

Also Present      Fred Hilden, City Recorder, Lisa Ekelund, Planning Official and 7 individuals.  

3.  Pledge of Allegiance  

All who were present stood for the Pledge of Allegiance.  

4.  Approval of the agenda  

Councilor Howison said he would like the discussion on the Business License Ordinance added to the Agenda.   

Mayor Hauptman said they would place discussion of the Business License Ordinance under Old Business.  

Councilor Navetta asked for clarification of Agenda item 12 (A) and wondered if this item includes the bridges.  

Mayor Hauptman said item 12 (A) only includes the gazebo but that the bridges will also be discussed as a separate topic tonight.

Councilor Navetta asked that the Water Quality report be added to the Agenda.  

Mayor Hauptman said they would place the Water Quality report that Councilor Navetta is speaking of in tandem with the other Water Quality report.  

Councilor Navetta said they could call it "Outlet Structure."  

Councilor Howison made the motion to approve the Agenda as amended.  Councilor Navetta seconded the motion.  The motion passed by unanimous vote.  

5.  Consent agenda  

·    City Council meeting minutes from 04/07/10 and 04/08/10

·    Bills of the session through 05/05/10

·    Receipts of the session through 05/05/10  

Councilor Navetta made the motion to approve the consent Agenda.  Councilor Ruede seconded the motion.  The motion passed by unanimous vote.  

6.  Announcements / Correspondence  

Mayor Hauptman announced that Ralph Farnsworth and Curt Peters are the two artists of the month.  The Mayor announced that volunteers are still needed for the Revenue and the Site Review Committees.  The Mayor also announced the May Birthdays, and Employee Anniversaries.  

7.  Citizen Input  

Alta Taylor ~ 84955 Hwy 101 ~ Florence  

Alta Taylor explained where her property is located.  Alta said she was wondering whether there would be any interest in having a few acres annexed into the City.  Alta said she has heard from people that Dunes City would probably not want to annex it.  Alta said she would hate to spend money to go through an annexation if it is not feasible.  Alta said she does not expect a decision tonight but she would like the Council to think about the proposal.  

Councilor Ruede asked Alta Taylor what the benefits would be if she were to annex into the City.  

Alta Taylor said she has two sons and three grand daughters and she would like to build houses on the property so that her family could reside close to her.  Alta said the benefit to Dunes City would be that they have several creeks that flow down into Woahink Lake.  Alta said the building permit and development fees would also benefit the City as a revenue source.  

Councilor Howison asked if there would be a total of five acres annexed, would each lot be one-acre lot making a total of five separate lots.  Councilor Howison asked if the County has different rules.  

Alta Taylor said they are currently zoned F-2 and they are not able to build on the property. Alta said she would be willing to annex 5 to 15 acres.  Alta said she would probably not annex her house because she has chickens and goats and she is not sure if Dunes City allows this.  Alta said she did speak with the Planning Commission at their last meeting.  Alta said she appreciates the Council's time.  

Councilor Howison said they need to look at the fifteen acres and they need to see where the wetlands are.  

Councilor Sathe said he thinks it would be worth looking at the site because of the feeder creeks and perhaps Councilor Koehler's Committee could go look at the site.  

Councilor Koehler said the first thing they would need to do is ask the County what restrictions are currently placed on the property.  

Mayor Hauptman said the City is empathetic to Alta Taylor's situation and it sounds like a big mountain to climb.  

8.  Mayor's report  

Mayor Hauptman reported that Patrick Mounts has completed his task of organizing and logging the Ordinances and Resolutions.  The Mayor said Patrick is an incredible young man.  The Mayor encouraged the Council to review Patrick's index.  The Mayor requested that the Council schedule a work session to go over the Ordinances and the index as prepared by Patrick.  

The Council decided to have a special work session on 06/15/10 at 6:00 p.m.  

9.  Committee / Commission reports  

·    A written report of the Police was received from Councilor Susie Navetta and placed on file.

·    Councilor Navetta said she does not have a report on the Community Center.

·    A written report of the Communication and Education Committee was received from Councilor Susie Navetta and placed on file.

·    Councilor Peter Howison gave a verbal report of the Conservation Committee.

·    Councilor Howison said he had no report for the Ordinance Review Committee.

·    Councilor Rebecca Ruede gave a verbal report of the Parks and Recreation Commission.

·    A written report of the Road Commission was received from the Councilor Troy Sathe and placed on file.

·    The draft minutes of the 04/19/10 Road Commission meeting was received by Road Secretary, Maria McConnell and placed on file

·    Councilor Jamie Mills gave a verbal report of the Site Review Committee.

·    Councilor Jamie Mills gave a verbal report of the Revenue Committee.

·    A written report of the Water Quality Committee was received from Councilor Richard Koehler and placed on file.

·    The draft minutes of the 04/21/10 Water Quality Committee meeting was received from Councilor Richard Koehler and placed on file.

·    A report of the Planning Department was received from Planning Secretary Lisa Ekelund and placed on file.

·    The draft minutes of the 04/22/10 Planning Commission meeting was received from Planning Secretary, Lisa Ekelund and placed on file.

·    The approved minutes of the 04/13/10, Stormwater Workgroup meeting was received from Planning Secretary, Lisa Ekelund and placed on file.

·    The draft minutes of the 04/20/10, Stormwater Workgroup meeting was received from Planning Secretary, Lisa Ekelund and placed on file.

·    A written report was received by Emergency Services Coordinator, Donald Hayes, read by Mayor Hauptman, and placed on file.

·    A written report was received by City Recorder, Fred Hilden and placed on file.  

Councilor Navetta made the motion to allow Don Hayes to sign up with the Oregon Emergency Management Association for the cost of $100.00.  Councilor Ruede seconded the motion.  The motion passed by unanimous vote.  

Mayor Hauptman called for a five-minute recess at 7:55 p.m.  

Council President, Peter Howsion, reconvened the meeting at 8:05 p.m. with the announcement that the Mayor needed to leave unexpectedly.  Councilor Howison said he would act as Chairperson through the conclusion of the meeting.  

10.    New business  

·    Road Commission Appointment  

Chairperson Howison announced that the City received one application for the vacancy on the Road Commission by Mr. Duke Wells.  

Councilor Sathe made the motion to nominate Duke Wells to the Road Commission.  Councilor Mills seconded the motion.  The motion passed by unanimous vote.  

11.      Public hearing  

·    Atkeson Conditional Use Permit Application  

Chairperson Howison opened the public hearing at 8:07 p.m.  

Chairperson Howison asked if any of the Councilors had ex-parte contact, bias, or conflict of interest and no Councilors announced ex-parte contact, bias, or conflict of interest.  

Steve Turner, attorney for Mr. Atkeson, approached the Council.  Steve said there was a public hearing at the last Planning Commission meeting.  Steve said there was some confusion as to whether the Commission was making a decision or if the Commission was making a recommendation.   

Chairperson Howison excused Steve Turner.  Chairperson Howison said at this time, he would step down from the dais.  

Chairperson Howison left the dais and took a seat in the audience.  

Councilor Sathe made the motion to nominate Councilor Ruede as Chair for this portion of the meeting.  Councilor Mills seconded the motion.  The motion passed by unanimous vote.  

Chairperson Ruede asked if there was any further testimony in favor of the application and no one spoke.  

Chairperson Ruede asked if there was any testimony against the application and Peter Howison approached the Council.  

Peter Howison ~ 83243 Kendall Lane ~ Dunes City  

Peter Howison said he was the complainant of this matter.  Peter said he became aware of this through neighbors who complained about these structures.  Peter said he took a canoe ride from the dock on Siltcoos Lake to the general area.  Peter said he saw backhoes and he became concerned.  Peter said he went to a private right of way of the Siltcoos Lake Club Plat, which was the closest location to the area that he could access.  Peter said at this time he saw a backhoe in operation.  Peter said he notified the City Recorder who upon notification issued a stop work order. Peter commended the Planning Commission for following the rules in denying this application.  Peter said it is unrealistic to argue that these are water related and water dependant structures considering it is in regards to a creek.  Peter spoke of the health of the lake and the necessity to maintain healthy wetlands and the necessity to prevent access to these sensitive corridors.  Peter said the Planning Commission has recommended the gazebo be removed by manpower and the same could be done to the bridges.  

Chairperson Ruede asked if there was any rebuttal.  

Steve Turner approached the Council.  

Steve Turner said he would like to make one point.  Steve said he does object to testimony or statements regarding the bridges because that issue has been dealt with and that issue is closed.  Steve asked that the Council to restrict any decisions to the gazebo.  

Peter Howison approached the Council.  

Councilor Mills said they have heard that the gazebo was constructed in 2005 and asked Peter Howison what date the new codes were adopted.   

Peter Howison said the new code was adopted in December of 2006.  

Councilor Sathe requested that he be allowed to ask Lisa Ekelund a question.  Councilor Sathe said that because no permits were originally taken out when these structures were made, wouldn't the code fall under when the permits were pulled.  Councilor Sathe clarified with Lisa Ekelund that because the application is being applied for now, current code would be used.  

Lisa Ekelund stated that Councilor Sathe is correct.  

Councilor Koehler asked Lisa Ekelund how the State Statues regarding riparian areas are applicable to this issue.  

Lisa Ekelund responded to Councilor Koehler.  

Chairperson Ruede asked if the Council has any further questions and no one responded.  

Chairperson Ruede closed the public hearing at 8:34 p.m.  

Chairperson Ruede said the Council would now go into deliberation.  

Chairperson Ruede asked the Councilors if she could hear a motion.  

Councilor Navetta made the motion to have the applicant remove the gazebo by 6/30/2010 and have the applicant get a vegetation removal permit and replant native vegetation in the area or be fined $500 per day and every other day thereafter.  Councilor Koehler seconded the motion.  

Councilor Sathe said he went out to the property today so he could make a fair assessment.  Councilor Sathe said he did not see a possible place to put the structure without removing it.  

Councilor Mills said she believes that the platform constitutes a water related structure, which is a permitted use.  Councilor Mills said if they do not go back to the old code and are in fact required to use the new code, whether or not it is a water related structure, this does not matter, if they are required to use the new code, the structure would be considered an accessory building and accessory buildings are not permitted to be placed unless a residential building permit has been issued.   

Councilor Navetta said there are several things that disturb her about the gazebo. Councilor Navetta said her number one issue it that it is raw lumber that has not been graded. Councilor Navetta said she worries about the integrity.  Councilor Navetta said her second concern is that according to the McAllister report, the structure needs additional work.  Councilor Navetta said she sincerely believes that it is up to Dunes City to remove this.   

Fred Hilden asked Councilor Navetta to clarify her comment that it is up to Dunes City to remove it.  

Councilor Navetta clarified her comment that it is up to Dunes City to order that the structure be removed.  

Councilor Mills questioned if they should accept the Planning Commissions recommendation.  

Councilor Navetta amended her motion to include support of the Planning Commission recommendation.  Councilor Koehler seconded Councilor Navetta's amended motion.  

Councilor Sathe there is one thing in the Planning Commission recommendation that he does not agree with.  Councilor Sathe said City Staff has to spend time on the application and the City cannot afford to give them a free demolition permit.  Councilor Sathe said they should require having the applicant pay the fee.  

Councilor Navetta amended her motion to include that the City charge for a demotion permit.  Councilor Koehler seconded Councilor Navetta's amended motion.  

Councilor Navetta amended her motion to include that the gazebo should be removed in a careful manner using manpower and small equipment.  Councilor Koehler seconded Councilor Navetta's amended motion.   

The motion to support the Planning Commissions recommendation except, have the applicant obtain, and pay for a demotion permit, have the applicant remove the gazebo in a careful manner using manpower and small equipment by 6/30/2010 and have the applicant get a vegetation removal permit and replant native vegetation in the area or be fined $500 per day and every other day thereafter passed by roll call vote as requested by Fred Hilden as follows:

Councilor Navetta made the motion that the City be reimbursed for the costs associated with the processing and abating of the violations pursuant to §91.29 Councilor Koehler seconded the motion.  

Councilor Mills said she does not believe they have the authority to make this decision, as it should be on the Agenda.  

Councilor Sathe agreed with Councilor Mills that it should be on the Agenda so Steve Turner will have a chance to look at it.  

The motion that the City be reimbursed for the costs associated with the processing and abating of the violations pursuant to §91.29 failed by roll call vote which is as follows.

Councilor Sathe made the motion that at the next meeting the Council will discuss the issue of reimbursement to the City for the time that has been spent in abating the nuisance.  Councilor Navetta seconded the motion.  The motion passed by unanimous vote.  

Councilor Navetta made the motion that at the next meeting the Council shall discuss the pavers that no longer have a necessity and the bridges.  Councilor Koehler seconded the motion.  

Councilor Mills said she understands the pavers but regarding the bridges there may be a question of a complete application.   

Councilor Sathe asked Lisa Ekelund what it would take to have a proper application for the bridges.  Councilor Sathe asked if the City has received engineered plans.  

Lisa Ekelund said the City has not received engineered plans.  

Councilor Sathe asked if the application was complete and Lisa Ekelund said the application is not complete at this time.  

Councilor Koehler said he would like a revision of the motion so that it goes through the Planning Commission.   

Councilor Navetta amended her motion so that it stops after the word "pavers."  Councilor Koehler seconded the motion.   

The motion that at the next meeting the Council shall discuss the pavers passed by a vote of 4 ayes and 1 nay.  The nay vote was made by Chairman Ruede.  

Councilor Navetta made motion that the issue of the bridges be sent to the Planning Commission for review.  Councilor Koehler seconded the motion.   

Planning Commissioner Lee Riechel approached the council.  Commissioner Riechel said the Planning Commissions review of structures of this nature should be reviewed under a variance or a Conditional Use Permit.  Commissioner Riechel said because the City Council last November excluded those two items, a review by the Planning Commission at this time would not appropriate.  Commissioner Riechel said if the Council is going to require further review or further action, the City Council must make the decision that a Conditional Use Permit would be required.  Commissioner Riechel said after the Councils decision, the Planning Commission can do something about it.  

Councilor Sathe asked Commissioner Riechel that since the criteria of the permit, since no engineering was produced for the permit it makes the decision null and void since it is not complete.  Commissioner Sathe said once the engineering is received, then the Planning Commission would look at it and give input to the Council.  

Commissioner Riechel said the Planning Department, which would be Lisa, would forward it to the City Engineers for evaluation.   

Councilor Mills said in her mind the question is not the engineering but rather, the question is the adequacy of the application and she would like a determination of the adequacy of the application.  Councilor Mills asked if it is a full and complete application that was filed in a timely manner.  

Fred Hilden said he spoke to Steve Winstead who is the Building Official. Fred said there are special considerations that need to be considered when approving bridges.  Fred said it is a Planning Department function to do that and there needs to be a review by our Building Official.  

Councilor Ruede said if they vote for this motion on the table, it would be referred to the Planning Commission.  

Councilor Sathe said he thinks they should have the Planning Department in the motion as Fred Hilden suggested.  Councilor Sathe said after the Planning Department reviews it, then it should go on the City Council Agenda.  

Councilor Navetta agreed with Councilor Sathe.  

Councilor Navetta amended her motion to send the application to the Building Department instead of the Planning Commission and have the item on the next Council meeting Agenda.  Councilor Koehler seconded the motion.  The motion passed by unanimous vote.  

Council President Peter Howison returned to the dais and assumed the role of Chairperson.  

·    Solid Waste Ordinance - Cancelled.  

12.      Unfinished / Old business  

·    Business License Ordinance Discussion  

Chairperson Howison suggested they put this item on next months Agenda.  

Councilor Sathe made the motion that they put the Business License on the Agenda for next month as a public hearing.  Councilor Navetta seconded the motion.  The motion passed by unanimous vote.  

·    Weir Discussion  

Councilor Koehler said there was a meeting with the Water Master of which John Stead was a part.  Councilor Koehler said the video is available if anyone would like to look at it.  Councilor Koehler said one of the issues with the report that the Water Quality Committee did is that it came up that they could incur a $150,000 cost for an engineer and they would be doing work on State lands.  Councilor Koehler said they could be setting precedence.  Councilor Koehler said it is a burden way over the City's budget, which includes the cost of a boat, storing the boat, and reworking the Weir.  Councilor Koehler said it is important to bring to light what they would be doing should they take on the cost of the Weir project.  

Councilor Sathe said he was under the assumption that Councilor Mills was looking into this.  Councilor Sathe asked Councilor Mills if she looked into this.  

Councilor Mills said they are supposed to try to negotiate at least one of the issues.  Councilor Mills said access is an important issue.  Councilor Mills said she was directed that she and Fred Hilden try to negotiate the access issue with Dr. Anderson.  

Councilor Ruede said she feels it is not appropriate to make sensational statements regarding the costs involved with the Weir and the structure because they are not based on fact.  

Councilor Navetta said it is important to bring up costs.  

Councilor Koehler said the cost of re-doing the Weir was a quote from the engineer on 4/7/09.  

Councilor Mills said the quote was that the engineer has seen costs that high when designing fish passages and the City is on the list to have this done for free from The National Guard.  

Councilor Koehler said he would like to see this come to a vote and be on the Agenda.  

Chairperson Howison said reason to take on the weir is to manage the Water Right.  Chairperson Howison said the issue is about the Water Right and if they should keep it or let it go.  

Councilor Sathe asked Councilor Mills if she has a timeline for her report.  

Councilor Mills said it would be helpful if they at least gave a report of their progress.  

There was a consensus from the Council that this topic is to be put on the Agenda.  

·    Interim City Recorder Status moved to permanent.  

Chairperson Howison said Fred Hilden has worked for the City for over a year now.  Chairperson Howison said Fred has taken the reign as City Recorder as many people have during challenging times.   

Councilor Sathe said he has probably worked with Fred more than anyone.  Councilor Sathe said the City could not find a better person than Fred to do this job.  

Councilor Koehler said he agreed with Councilor Sathe's comment as far as finding a person.  Councilor Koehler asked how many applicants there are.

Fred Hilden said the City has received no applicants.  

Councilor Koehler said as a procedure, he would like the City to give that extra effort in looking into who could fill that position.  Councilor Koehler said he would like the City to rethink the salary figure and the need to set working hours established in the contract as well as in the job description.   

Fred Hilden said he would like to clarify that the starting salary for the last City Recorder was $3,000 and the last City Recorder's ending salary was $3,300.  

Councilor Ruede made the motion that the Council adopts Fred Hilden as the City Recorder. Councilor Sathe seconded the motion.  

Councilor Mills amended the motion to read that the City move the Interim City Recorder to permanent status at his current pay rate to allow an opportunity for us to negotiate a contract under terms that the City Council and the new City Recorder can agree to.  Councilor Ruede agreed to amend the motion.  Councilor Sathe seconded the amended motion.  

Councilor Navetta said she would like to wait another month for a contract so they know all of the details.  

Councilor Mills said she also wondered what the rush was but after speaking with Fred Hilden, she understands that as long as Fred is considered "Interim," he is tying up the Administrative Assistant position.  Councilor Mills said having the City Recorder on permanent status allows the City to hire an Administrative Assistant.  

Councilor Sathe said with the amendment made to the motion it still gives them the right to negotiate the contract.   

Councilor Ruede said in light of Councilor Mills' comments she believes the newly adopted budget will be impacted. Fred Hilden clarified that the 2010-2011 budget included funds to hire a part time Administrative Assistant.  

Chairperson Howison said it does not make sense to go through the extra effort if something is working.   

Councilor Navetta said she understands Councilor Koehler's concerns. Councilor Navetta said they have hired some very poor City Administrators.  Councilor Navetta asked Fred Hilden to forgive their caution.  

Fred said he understands.  

Councilor Koehler said he has seen mistakes he has made and he wants a process that completes itself.  

The motion that the Council move Fred Hilden, the Interim City Recorder, to permanent status at his current pay rate to allow an opportunity for us to negotiate a contract under terms that the City Council and the new City Recorder can agree to passed by a vote of 4 ayes and 1 nay.  

13.    Adjournment  

There being no further business to come before the City Council, Councilor Ruede made the motion to adjourn the meeting and Councilor Sathe seconded.  The motion passed by unanimous vote.  

The meeting of the Dunes City Council adjourned at 9:56 p.m.

Mayor’s Report to City Council

May 13, 2010  

As discussed on several occasions over the last month, I have directed Patrick Mounts, a University of Oregon senior, to locate and read all Dunes City ordinances and resolutions. Further he was asked to electronically index, cross-reference to both other ordinances and resolutions, check for signatures and digitize all ordinances and resolutions that were not already digitized.  

I am pleased to announce that Patrick has completed these projects and a copy of the updated list or ordinances and resolutions is attached. Proofing and verification of these lists has not been completed so please be patient with minor errors you may find in reviewing them.  

With this effort being completed we are ready to move on to ensuring all of the ordinances and resolutions are properly incorporated into our Dunes City Code of Ordinances as part of the Codification Project.

Communication & Education Committee

Report – May 13, 2010  

The Communication and Education Committee held the fourth annual Community Pot Luck on April 17th.  

Councilor Jamie Mills and her family surprised the committee by setting up the tables before the appointed time.  David Bellemore, Cynthia and Mark Chandler, Ralph Farnsworth, Mary Jo Leach, and Susie Navetta decorated the meeting hall.   

The Pot Luck could have had better attendance, but the folks that attended seemed to have a good time As usual the shared food was excellent.  In attendance were Theresa Baer (Editor of the Siuslaw Newspaper), George Goldstein of Florence who in the past years has helped Dunes City with Lane County road issues and Star and Jerry Rust.  Jerry is running for a West Lane County Commissioner seat.   Lisa Ekelund the Dunes City Planning Secretary was present.  Sally and Fred Hilden also attended.  Fred is the Dunes City interim Recording Secretary.  

The next event for the Communication & Education Committee will be the second newsletter of the year. Look for it in the first part of August.  The newsletter will be announcing next the Festival of the Lakes.

Police Report  

On April 21, 2010 a resident called to complain about a neighbor.  She said the neighbor had his dog tethered close to her fence and was concerned because her well is close to that property line.  She is worried that the animal residue will contaminate her water supply.  She also told me her husband had approached the resident and had not been successful in getting him to move the dog to another area of his yard.  She then contacted the owner of the property to no avail and called me for assistance.  I contacted the Planning Secretary and she said she could send a letter to educate the resident about the Ordinances in Chapter 92 dealing with dog housekeeping.  Hopefully this will take care of the matter.

Emergency Services Coordinator report      

May 01, 2010  

Since my appointment on March 22nd 2010 as the Emergency Services Coordinator for Dunes City, I have had an agenda of moving this office forward.  We have had a radio net action, and tracking exercise with the Local EOC, ARES and found some radio communication wanting and in need of fixing.  We are in the process of making corrections.  

As the designated representative for Dunes City, I have attended three meetings of West Lane Emergency Operations Group herein referred to as "The Group". This Group has developed methodology for a South of the bridge action plan centered around a container at St. Mary's Church located on Highway 101.  This action plan will include stored in place supplies, and a base radio such as the radio located at Dunes City Hall.  This plan will allow for better relays to the tower. Along with St. Mary's Church, there is also a plan to utilize the Siuslaw Fire Station on Clear Lake Rd. using hand held radios, and shelter in place.  

Dunes City needs to start a training program to provide information for its Citizens such as the Citizens Emergency Response Training (CERT) used in Florence.  The funds for this have been budgeted by the EOC and are ready to be used. We then need to start getting the City Council and other volunteers trained for the leadership positions needed, as well as the citizenry.  I have attended budget meetings and funds for Dunes City are part of the group's budget.   

There is an ICS training course from 2:00 p.m.-8:00p.m. on June15th-17th 2010.  You (anyone who reads this memo) should go!  Along with Dave Davis of Florence, I would like to become a member of the Oregon Emergency Management Association. The cost of becoming a member is $100.00 per year and their meetings are mostly held in Salem.  There is a vast amount of information available but I wish to keep your interest up, and not bore you so I will save some for next time!

Road Commission Report

May 5, 2010

The regularly scheduled Road Commission met on April 19, 2010 at 6:30 PM.  At that meeting I was acknowledged as the Road Commission Chair.  

The Road Commission approved the budget for the 2010/2011 Budget Year.   

The Dyer Partnership was appointed as the City's Engineering representative.  They will begin the bidding process for this year's road projects.   

At the direction of the City Council, the Road Commission directed two members to review the Woodland Lane project involving the City's owned easement of Francis Bay Lane.  The Road Commission members will attempt to come up with a resolution of the problem regarding the water/electrical lines placed in the easement.  

The Road Commission voted unanimously to send a Certified Letter to Mr. & Mrs. Thomas Skeele regarding their illegal placement of a fence and gate on Foothill Drive on property located in the Dunes City limits and blocking access to property owned by the City known as the "playground lot".  Mr. Skeele called me after receiving the letter and advised me in a very loud manner that all the documents the City sent him were "falsified documents" and he would like to sue the City.  I advised Mr. Skeele to attend the next regularly scheduled Road Commission meeting on May 17, 2010 to present his evidence that the County has led us astray.  

Commissioner Smith has been assigned the task to look for a trailer to purchase to haul debris from our work party brush cutting projects.  In April we started cutting brush on Kiechle Arm Road and made quite a dent and made the residents down there very happy.

Water Quality Committee

Report to Council         5-13-10

In my absence John Stead chaired the April Water Quality Committee meeting.

In that meeting

(DEQ) and the Department of Human Services (DHS) and Senator Dingfelder will be holding a meeting in Portland on the 21st of this month regarding Blue Green Algal (BGA) incidents, and we were asked to comment on our experiences.\

The Committee will send a written report to the meeting including:

a.      Lane County and Douglas County – have not come forward with any assistance.  Who is responsible for monitoring water for public safety?  The County says there is no money available.  Our committee thinks that there is a lack of support from outside agencies.

b.      State and Federal – Neither Health and Human Services (HHS), DEQ, nor the Oregon Dunes National Recreational Area have helped.

c.      County, State and Federal relationships are poor to nonexistent.

d.      Recommendations and Questions –

·   How severe does the scum on a lake have to before DHS steps forward? 

·   How can they tell if it’s toxic unless they do some tests? 

·    Can they post a lake with Toxic signs without testing? 

·    Which agency should take the ‘lead’ in the event of an algal bloom?

·    Who will be protecting the Marine Reserves, DHS or the Environmental Protection Agency? (We believe EPA should be involved in some way.)

Mark Chandler and Steve Hager reported that we now have 20 years of Secchi (clarity) readings.  They presented a preliminary chart of Woahink Lake.  New graphs will be made from the charts.

Old Business – Woahink Lake Protection – A lengthy review of the committee’s concern of the riparian area took place.   Members have documented photographs of the Woahink Lake frontage and the Clear Lake barriers near Reedsport and its example to what could occur on the vulnerable lakeshore area across from The Myrtlewood.   Also reviewed were meetings the water quality committee has had with ODOT.

In the Month of April, Dunes City issued 13 permits.  It is anticipated that the first new home construction permit will be issued within the next couple of weeks.  

At the last Planning Commission meeting, the Commissioners held a public hearing for a conditional use permit application submitted by Mr. Greg Atkeson.  The Planning Commission came to a unanimous decision to deny the application based on Dunes City's applicable codes.  

The Stormwater Workgroup had meetings on April 13th, and April 20th.  All of the Workgroup members are working hard and they are making progress.  

The next regular session of the Planning Commission is scheduled for May 27, 2010 at 6:00 p.m.

 City Recorder Report to City Council

The month of April found me picking up the pieces and attempting to fulfill the requirements of the City Recorder position. In addition to major tasks like familiarizing myself with the office of the City Recorder, the Oregon Public Employees Retirement Program, the record for Woahink Ridge Estates, the record for Montgomery View Estates and all of the operational and legal matters associated with a changing of the guard in the City Recorder’s office, I facilitated a smooth transition in the supervision of City staff.  

As approved by City Council, a performance and wage review was administered for Lisa Ekelund, Planning Secretary, with input from Mayor Hauptman and Planning Commission Chairman, David Bellemore. I also assisted Patrick Mounts in planning and execution of the Ordinances and Resolutions Project that was launched by Mayor Hauptman.  

The final water meter readings for Water Year 2009 were input to the State’s online usage database by the April 30th deadline and for the first year that I am aware of, Dunes City is in full compliance with our State water right #S33923 for Domestic Use of water from Woahink Lake.  

Finally, the single largest project completed in April was the City’s 2010-2011 operating budget. I am pleased to announce that the 2010-2011 Dunes City Budget and the Budget Message were completed on time and presented at the first Budget Committee meeting on April 27, 2010. At the first Budget Committee meeting, Mayor Hauptman was nominated / elected chairman.
