 1.     Call to Order and Roll Call  

Mayor Eric Hauptman called the meeting of the Dunes City Council to order at 7:03 PM .  

2.     Roll Call  

Roll Call was taken by Dunes City Recorder, Amy Graham.  

Present:    Mayor Eric Hauptman, Council President Peter Howison, Councilor Susie Navetta, Councilor Robert Quandt, Councilor Richard Koehler, and Councilor Rebecca Ruede.  

Absent:     Councilor Jamie Mills (excused)  

Also Present:        Dunes City Recorder Amy Graham , Planning Secretary Lisa Ekelund, Ryan Cronk from The Siuslaw News, and 7 individuals.  

3.     Pledge of Allegiance  

All who were present joined in the Pledge of Allegiance.  

4.     Consent Agenda

Councilor Quandt made the motion to accept the consent agenda and the motion was seconded by Councilor Howison.  The motion passed by unanimous vote of 5 ayes and 0 nays.  

Councilor Koehler requested the city recorder send him the budget vs. actual so he can post it on the web and Mayor Hauptman agreed that it was a good idea.  

5.     Announcements / Correspondence  

Mayor Hauptman announced the Festival of the Lakes will be held 08/08/09 from 10:00 am to 3:00 pm .  

Mayor Hauptman announced the CCI meeting for Stormwater will be held on 07/16/09 at 6:00 pm .  

Mayor Hauptman announced Dunes City will be holding a Clean up Day.   

Councilor Navetta announced the clean up day will be on Saturday 7/11/09 at 10:00 am .   

Councilor Navetta announced they are having a newsletter folding day on Monday 7/13/09 at 9:00 am .  

6.     Committee / Commission Reports  

  • A report of the Communication and Education Committee was received by Councilor Navetta and placed on file.
  • A report of the Conservation Committee was received by Councilor Howison and placed on file.
  • A report of the Parks and Recreation Committee was received by Councilor Ruede and placed on file.
  • A report of the Road Commission was received by Councilor Quandt and placed on file.

In addition to Councilor Quandts' submitted report, Councilor Quandt said the available funds from the Federal Government was $100,000 and the State has a fund exchange program where they were able to reduce some of the restrictive Federal requirements.  Councilor Quandt said they charge 6% and this agreement before the council lays out some of the constraints.  

Mayor Hauptman said in the agreement, the term "council" refers to the city attorney.  

Councilor Quandt said it needs to be in by the 20th.  

  • Regarding the Revenue Committee, Mayor Hauptman asked Tracy Quandt if she knew anything about the proposed burning permit suggested by the revenue committee.  Tracy Quandt said they are not considering the burning permit.

7.     Unfinished / Old Business  

  • Atkeson Property Appeal Map/Tax Lot Number 19-12-27-40-02200

Amy Graham said the city has given Mr. Atkeson's attorney, Mr. Steve Turner, all requested information.   

Amy Graham said she was told the Skeele's have hired an attorney and they are still in negotiations.  

Mayor Hauptman questioned if there is anything new.  

Amy Graham said Mr. Turner stays in contact with the city.  

Mayor Hauptman requested the city recorder to provide him with Mr. Turners' telephone number at a later time.  

8.     New Business  

  • Proclamation declaring July as Oregon National Guard Month

Mayor Hauptman read a proclamation declaring July as Oregon National Guard Month and encouraged all citizens to join in this observation.  

  • Zoning & Development Code Audit

Mayor Hauptman said this is something the city requested Mr. Larry Lewis to do because it was brought up several years ago that the city has a disconnect on the comprehensive plan and some of the ordinances.  Mayor Hauptman said they want the ordinances and comprehensive plan to be more effective and easier to follow.  Mayor Hauptman said they would like to hand Mr. Lewis' suggestions to the Ordinance Review Committee and proposed a day in September for the Council to have a study session.  

The Council decided to have a study session on Tuesday 9/29/09 at 6:30 pm .

Councilor Howison said he would like to work on this with the Ordinance Review Committee in August and requested at least another council is involved.  

Councilor Ruede said she would help and Mayor Hauptman said he would help.  

Councilor Koehler suggested they have the office OCR all of the previous ordinances so it can all be electronic for review.  Councilor Koehler said they need to consider the cost of doing this.  

Councilor Ruede asked if they have allowed this cost in the 2009-2010 budget and questioned which line item it would be.  

Mayor Hauptman said they are not sure how much this will cost because they are in the preliminary stages but he sees this as a 2010-2011 expenditure.  

Councilor Navetta said the last time the city did this; they received a grant for it.  

Amy Graham said she forwarded a grant application to the revenue committee for updating the code book and Amy said she heard nothing back.  Amy Graham said when she asked Councilor Mills, Councilor Mills said they were not able to file for the grants.  

  • Committee Appointments

Councilor Navetta made the motion they approve Marilyn Miller, Jo Owen, and April Dumas to the Budget Committee. Councilor Koehler seconded the motion.  The motion passed by unanimous vote of 5 ayes and 0 nays.  

  • Resolution series 2009 No. 1 – A resolution of the City Council of Dunes City in establishing a formal sister city relationship with Dunes, France

Mayor Hauptman read the resolution series 2009 No. 1 in its entirety.  

Councilor Quandt said perhaps they should give a brief history on how this came about.  

Mayor Hauptman said it began with Amy Graham calling him saying there are people in the City Hall who speak only French.  Mayor Hauptman said Debbie Pasternak speaks French so he brought her to the city.  Mr. Jean Pierre from Dunes, France brought bottles of wine and gifts to the city to extend their hand in friendship.  

Councilor Howison said he is going to be traveling to Dunes, France .  

Councilor Ruede said she likes the resolution and in the interest of promotion she would like to make the motion to expend $300 from the marketing committee to offer something as a gesture of our token.  Councilor Quandt seconded the motion.  The motion passed by unanimous vote of 5 ayes and 0 nays.  

The council decided to give Dunes, France the population sign of Dunes City which lists 1200 people because Dunes, France has the same population and Dunes City needs an updated one.  

Councilor Quandt made the motion to adopt the resolution series 2009 No. 1.  Councilor Ruede seconded the motion.  The motion passed by unanimous vote of 5 ayes and 0 nays.  

  • May Property 5568 Woahink Dr. – Nuisance

Councilor Navetta made the comment that Councilor Mills said the side yard setback newest addition needed to be removed.  Councilor Navetta said it was removed but the deck is still in the side yard setback.  Councilor Navetta said there is a tool shed that was to be changed from being closed in to being open to be legal and it has not been done.  

Councilor Ruede suggested they wait for Councilor Mills to return so they could hear her report.  

Councilor Quandt made the motion to table this topic until the August meeting.  Councilor Ruede seconded the motion.  The motion passed by unanimous vote of 5 ayes and 0 nays.  

  • Petersen Property 5366 Buckskin Bob Rd. – Nuisance

Mayor Hauptman said there are 13 vehicles on this property.  

Councilor Quandt said it sounds like this one has been a property violation for a long period of time but there has been no action.  

Councilor Quandt made the motion that they declare this violation on 5366 Buckskin Bob Road a nuisance and direct the city recorder to begin abatement.  Councilor Howison seconded the motion.  The motion passed by unanimous vote of 5 ayes and 0 nays.  

  • Abandoned Trailer on Big Annie Lane and Buckskin Bob Camp – Nuisance

Councilor Quandt said this is another nuisance that nobody has taken any action on.  

Councilor Quandt said nobody is claiming ownership of this and it appears to be on the city right-of-way.  Councilor Quandt said he would be willing to tow it away if he had a hitch.  

Councilor Quandt said there is a sign right in front of the trailer that reads "no vehicle parking, vehicles will be towed at owners expense" and he would consider that notice.

Mayor Hauptman directed the city recorder to tack a notice of abatement up.  

Amy Graham said they need it in the form of a motion  

Councilor Quandt made the motion to declare the trailer illegally parked on Big Annie Lane and Buckskin Bob Camp, a nuisance.  The motion was seconded by Councilor Ruede.  The motion passed by unanimous vote of 5 ayes and 0 nays.  

Councilor Quandt made the motion to declare the trailer a nuisance and direct the city recorder to post the abatement notice for 10 days and direct the road commissioner to remove the trailer after 10 days waiting period.  The motion was seconded by Councilor Howison.  The motion passed by unanimous vote of 5 ayes and 0 nays.  

  • Discussion on Ordinance No. 184 – Adding the word "unconfined" to Section B(2)(e).

Darlene Beckman 82150 Booth Island  

Mrs. Beckman said Ordinance 184 deals with the un-platted section of Booth Island .  Mrs. Beckman said they would like to make the simple request to add the word "unconfined" before the word pets to section B(2)(e) of Ordinance 184.  

Councilor Howison asked Mrs. Beckman if she remembers why that section was put in.   

Mrs. Beckman said at the time they requested this and they now regret it.  

Councilor Howison said this provision was made because of the Open Space Overlay.  

Mrs. Beckman said at the time they felt this provision was appropriate but they have since realized there are people on the island that do have pets and there are others who bring their pets.  Mrs. Beckman said this would allow confined pets but not allow free running dogs or cats.  

Councilor Quandt said the request sounds reasonable.   

Councilor Navetta said she is not ok with the request.  Councilor Navetta said she would not like to see cats that continually breed.  

Mrs. Beckman said they self imposed some restrictions and they worked back and forth with the city.  Mrs. Beckman said she believes this is a small request.  

Councilor Howison said Dunes City already has a leash law for dogs.  Councilor Howison said he believes the eco-sphere would drastically change if they allowed this.  

Mrs. Beckman said the majority of the island is considered un-platted.   

Councilor Koehler said there is no real regulation there because who is going to know.  Councilor Koehler asked specifically what has been changed in the document.  

Mrs. Beckman said they only want to add to work the word un-confined which would make the property owners able to have confined pets.  

Councilor Navetta said she is concerned because there are many copies of the ordinance.  Councilor Navetta said the ordinance they voted on in the past is different then the signed ordinance in the drawer.  

Councilor Navetta said they should listen to the old tape.  

Mayor Hauptman there a couple of issues, 1, can they go through tapes?  Mayor Hauptman said it may have been read by title only.  

Amy Graham said they could listen to the tape.  

Councilor Koehler said they should table this.  

Amy Graham said they would need to do a 45 day DLCD notice to change this word.  

Councilor Navetta asked how much this will cost the city.  

Amy Graham said she estimates it would cost around $400.  

Mayor Hauptman asked if Mrs. Beckman would be willing to pay for this.  

Mrs. Beckman said the last time she was asked this she was quoted $1,500 and she ended up paying $15,000.  Mrs. Beckman said she would be willing to pay, but with a cap.  

Councilor Koehler asked what this remedies to Mrs. Beckman.  

Mrs. Beckman said it makes it fair to the property owners.  

Mayor Hauptman asked the city recorder if she would be willing to undertake this and get back to the council next month.  

Councilor Ruede made the motion they table this subject to the next council meeting.  Councilor Quandt seconded the motion.   

The council discussed the steps and procedures they need to take.  

Councilor Navetta said they have 3 different copies of the ordinance and they need to verify them.  Councilor Navetta said the size of the lots was deleted and she believes it to be important.  

Councilor Koehler said perhaps adding the deleted words would be an additional change.  

Councilor Quandt said this appears to be a copy of the ordinance before it was modified.

Councilor Quandt said they need to find out the correct version, send it to the Planning Commission, and go through the correct process.  

Councilor Ruede called the motion to question.  

The motion to table this subject passed unanimous vote of 4 ayes and 1 nays.

Councilor Quandt made the motion to send the request to the Planning Commission for them to review it at the July 16th meeting.  

Amy Graham said she believes it to be too soon.  

Mrs. Beckman said her request is minor and if the city decides to make more than the requested one word change, she will not pay for it.  

Councilor Quandt withdrew his motion.  

9.       Adjournment  

There being no further business to come before the City Council,  

Councilor Koehler made the motion to adjourn the meeting and Councilor Quandt seconded.  The motion passed by unanimous vote of 5 ayes and 0 nays.  

The meeting of the Dunes City Council adjourned at 8:50 PM .  

The next scheduled meeting of the Dunes City Council is to be held on August 13th, 2009 at 7:00 PM .

DUNES CITY ROADS COMMISSION

July 9th 2009 Report to Council

 

The volunteers of Dunes City Roads Commission are working hard for the Citizens in many ways. There are new budget challenges that require us to get more efficient and adapt to a new economic environment. Given the fact that the County has cut our roads budget IN HALF, we have to transition to a new strategy. This strategy involves two fronts. The first is to transition to a more efficient and more effective maintenance program. Second we need to find new ways to pay for it. Without the County contribution to our roads funding we need to fill that gap by aggressively pursuing grants.

The maintenance strategy “Preventative vs. Corrective”. First, it’s important for the community to understand some of the details behind how pavement deteriorates. It deteriorates slowly until the top layer allows water to start penetrating. When it does, it starts deteriorating quickly. If you preserve it before it gets to that point the maintenance cost is reduced. A preventative slurry-seal coat applied sooner is cheaper than a corrective chip-seal or pavement overlay later. Cities have found the preventative program up to four times cheaper in the long run. We still have corrective pavement overlay projects but its good practice to try and avoid them and work towards a time when the entire Dunes City road system is in preventative maintenance mode. The closer we move toward that, the less it will cost us.

How were this years maintenance the projects identified? The roads we will be maintaining this year were identified based on standard pavement condition index numbers (PCI#). Our pavement management system compares those numbers with standard pavement deterioration curves. Appropriate types of maintenance are applied based on the PCI#. The list will be posted to the Dunes City website this month.

Victory for Dunes City. Slurry seal program will be funded by a federal grant. Our Slurry Seal program was one of 52 projects selected from a pool of 125 applicants fighting for a limited number of Federal grants. The Small Cities Stimulus program has responded to our application with $94,000 for the slurry seal program. This project preserves up to 20 streets throughout the City.

Also we have an overlay project involving 5 streets that will be paid for by the city. These projects are being quantified and prepared for the bidding process. Both these maintenance programs are scheduled for bidding in July and construction comes in August and September. In July we will begin communicating with the residents on the affected roads informing them as to what to expect and when to expect it.

We are lucky to have an energetic involved Road Commission. Please remember we are just volunteers and we could use more. Even if its just to give input at a road commission meeting. If you have input on decisions that are being made or any other issues, we would appreciate that information while were making the decision. That is the point when your input has usable value and can help shape the decisions. Also your welcome to help us as we start our brushing and limbing jobs around the city. Dog Complaint

Dan Jones of 83682 Rio Road, (902-1998) called the Dunes City office to report a pit bull dog running loose. This is the second time the dog has been aggressive toward Mrs. Jones, the first time she was alone. The dog came running at her and she called out to the dog, “Get away, get away”. A young couple came out and removed the dog and apologized.

The second time Mrs. Jones was with her husband and the dog was more aggressive than the first time. An older man came out when they yelled, “Get away, get away” to the dog. The dog came closer and Mr. Jones kicked at the dog to protect himself. An older man appeared said the dog was reacting to Mr. Jones. The dog did not have a collar and the owner had a difficult time removing the dog from the area.

It was believed that the dog resides with Herbert Rushford of 83592 Manzanita Drive. Rushford said the dog was friendly and a pleasure to be around. He reported that the true owner of the dog was Howard Goldstein family of 83589 Manzanita Drive (997-6024). Mr. Goldstein came out with his dog who greeted me in a pleasant way. Mr. Goldstein said he was sorry about the incident and he would be willing to meet with Mr. and Mrs. Jones and introduce them to his dog. He also said he didn’t know there was a leash law and would read the ordinances I gave him.

I called Mrs. Jones and told her that Mr.Goldstein would like to have her meet the dog. Mrs. Jones said she would think about calling him.

Water Quality Report to Council   July 9th

I thank John Stead for leading the June 17th meeting in my absence

Are the purposes and the duties of the Water Quality Committee being moved forward was a question posed to the committee. The WQC believes that an Intergovernmental Agreement with Lane County is necessary so that we are aware of what is happening in the six mile sphere of influence.

The standing water at Gibbs Creek is still an issue. The committee tried to determine who is responsible for the standing water on Clear Lake Road. This area has a high phosphorus and E Coli count. Preparation for Blue Green Algae Bloom is in place with the Protocol passed last month at the City council meeting.

Rich Miller (PSU) will be finishing the report for the 303D in the next few months regarding Siltcoos Lake water and the 319 grant which has come to an end. The DEQ is optimistic that the EPA/SRF safe drinking water grant funds will be available soon.

Helping Lakeside owners understand weeds will be part of this years Festival of the Lakes. Word that the Woahink Lake Association will have a stewardship booth and Planning Commissioner Dave Bellmore will have a riparian booth lends to the public understanding more about their responsibility in maintaining their water quality.

Volunteering their time, Gerry Curran and Brien Mills will be pulling and collecting weeds this summer near an eleven family Ford Way community water system. Honeyman Park will dispose of the invasive weeds that are pulled.

Amendments to the Septic System Maintenance Ordinance will be reviewed by the committee this month.

Testing has taken place at Honeyman Park at no cost to Dunes City. What is enabled is cooperation with outside groups and neighbors.

Septic System Maintenance Ordinance will be reviewed at the July 15th meeting.

Festival of the Lakes Committee

June 12, 2009 Minutes

 

Councilor Susie Navetta opened the meeting at 10:03 AM. Committee members present were April Dumas and Susie Navetta. Linda Ash was absent. Dave Bellemore, Richard Koehler, Marilyn Miller, Annie Navetta, and Jo Owen were also present.

Susie Navetta reported that Linda Ash was still away and that Paul Floto handed in an application that will go top the council in July for approval.

Topics for discussion were:

Entertainers – Christine May will contact Lori Robertson from Mosaic Waters and Tim the Balloon Man. Susie Navetta will contact the Heritage Players, Indian Dan (Dave Dumas), Logger Bob (Jackson), Lily Cox Hurd (Annie Schmidt). Smoky Bear, Dunes City Fire Captain Terry Madden, and Mike Jacobson the Kareoke King will also be contacted by Navetta.

Sponsors – Richard Koehler will contact Bill Fleenor and Econo Rooter, Jamie Mills will be asked to contact Combest Investments and Susie Navetta will contact the Three Rivers Casino. Sponsorship for the entire FOL remains at $250.

Raffle Prizes – Susie Navetta will write a letter for volunteers to take to businesses seeking donations or gift certificates. The committee divided up the list.

Councilors – have been contacted to find out how they wish to participate in the FOL.

Councilor Richard Koehler will be an announcer. Hopefully, Councilor Jamie Mills will share her Aqua Screen Matting experience. Mayor Eric Hauptman will conduct the opening ceremonies. We hope councilor Peter Howison will conduct our Cake Raffle again. Other Councilors may wish to participate too.

Booths- letter have been sent to businesses and others who would like booths and already some have responded. We will have to find a new food concession and of course we are always looking to expand.

Speakers – a number of speakers were suggested. The first to be called are Mark Chernaik from Science for Environmental Science, Steve Hager a Oceanographer who does our water testing, and Honeyman Park’s Grant Christiansen who speaks to all age groups.

Volunteers – Heading off the list is Planning Commission Chair Dave Bellemore who will man a table with Riparian Information. Jo Owen told us of the brown bag sales and will be hosting a hot dog party on July 25th at 11:00 AM., at her home, for assembly of the bags. The bags will contains “others treasures” and be sold for $1.00. A smaller version of the bake sale will also be an attraction and of course the bake sale raffle will need some delightfully tasty wares. Richard Koehler will handle all the outdoor signs. Susie Navetta will make the indoor signs. A long list of volunteers called into action soon.

Newsletter – Richard Koehler will be editing the summer edition of the Dunes City Newsletter. The Chairman of each committee has been contacted and asked to write a page for the next issue. The theme will be the same as the FOL “What Can I Do for My Town?”

The FOL Committee plans to hold anther meeting to be determined at a later date.

Communication and Education Committee Festival of the Lakes - June 30, 2009 Report

Chairman Susie Navetta opened the meeting of the Communication and Education Committee sub-committee for the Festival of the Lakes at 10:05 AM .

Those present were April Dumas, Paul Floto (newly appointed) and Susie Navetta. Linda Ash was absent. Also joining the meeting were Councilman Richard Koehler, Planning Commissioner Marilyn Miller and Road Commissioner Jo Owen.

This follow up meeting went over the entire list of participants for the festival making sure that all bases were covered not only by invitation but in person if necessary. Assignments were passed out for getting Sponsors and Raffle Prizes. Some of the businesses and agencies have still not responded and they will be called to finalize their needs this week. Mark Cherniak from Environmental Law Alliance will be the key note speaker this year. Other speakers are Dunes City Water Tester Mark Chandler, Grant Christiansen from Honeyman State Park, and Frances Klipple the Herbal Enthusiast.

Susie Navetta met with Jack Gentle from the Tide's Inn who will serve food and beverages this year.

Betty Romero donated 3 beautiful photographs - the Heceta Light House, the Florence Bridge and the Eye of the Cat. These photographs will be auctioned off at the close of the festival.

The summer newsletter will go to print this week and be folded on July 13th at 9:00 AM and will be delivered the following day.

Press releases have started in the Siuslaw News and will continue weekly until the festival.

The Festival of the Lakes will be held on August 8th from 10:00 AM to 3:00 PM .

DUNES CITY COUNCIL PLANNING DEPARTMENT STAFF REPORT JULY 2009

The last planning commission meeting for June was cancelled. The next regular meeting has been moved from July 23rd to July 16th at 6:00 PM where they will hold another CCI meeting relating to the stormwater ordinance. Far those who have any questions I'm available during our new office hours of Monday through Thursday from 10 am to 4 pm .

The planning staff would like to thank all of the citizens involved for their meticulous efforts and feedback on the stormwater ordinance. Staff would also like to point out that for those who are interested our webmaster has pasted helpful links to assist in understanding stormwater plus, you can review CCI minutes dated back to 2005. This historical memory is important for our progression and we owe Councilor Koehler a big thank you for his efforts.

At the last city council meeting, the council declared a nuisance on a property located at 83501 Jensen Lane . Planning staff prepared a notice of abatement and forwarded it to the city recorder. The city recorder posted the declaration of a nuisance on the property and mailed it by certified mail on 06/22/09 . The city received the returned signature card from the post office on 6/26/09 . To the planning staff’s knowledge as of 06/30/09 , no contact has been made by the Cloughs in regards to this and the deadline to abate is 07/02/09 .

On 06/17/09 I was told by the Planning Chairman that he and the Conservation Committee Chairman believe that was a large pile of dirt in the shoreland zone located on the Trent property at 83421 Hwy 101. I went along with the city recorder to view the property an the same day. The surveyor has marked the setback and the contractors have put up a silt fence to protect the land from erosion. We saw no piles of dirt in the shoreland zone. The city recorder and f had a lengthy discussion with the contractors on the importance of protecting all sensitive areas from pollution, erosion, and runoff.

On 06/30/09 planning staff spoke to Mr. Tom Kollmorgen to follow up on a tree removal he did 2 years ago. Mr. Kollmorgen said he forgot to replant the trees that are due for inspection this year so he planted them last week. Planning staff informed the conservation committee of this. Mr. Kollmorgen is very cooperative with the conservation committee reviewing his work. To this date planning staff is not aware of a scheduled site review.

Within the month of June as of 06/30/09 Dunes City issued 7 electrical permits, and 5 building permits. Thank you.
