1.  Call to Order and Roll Call  

            Mayor Eric Hauptman called the Meeting of the Dunes City Council to order at 7:02pm .  Amy Graham, Dunes City Recorder, took roll call. 

Present:          Mayor Eric Hauptman , Councilor Gerald Curran, Peter Howison, Councilor Richard Koehler , Councilor Susie Navetta, and Councilor Robert Quandt.   

                        City Recorder, Amy Graham stated Councilor Robert Petersdorf’s sister called this morning stating he was hunting and would not be present this evening.  

Others Present:  City Recorder Amy Graham, Planning Secretary Lisa Ekelund, and 28 members of the community.   

2.  Pledge of Allegiance  

            The Mayor, city councilors, office staff, and citizens present joined in the Pledge of    Allegiance.  

3.  Consent Agenda  

            A.  City Council meeting minutes of 09/11/08  

            Councilor Howison stated he thought the ordinance and resolutions should be referenced.  It’s ordinance 168 and it should be identified.  

Councilor Howison moved to accept the minutes with the condition that the names of the budget and transferring of funds resolutions are added.

            B.  Bills of the Session through 10/08/08           

  C.  Receipts of the Session through 10/08/08

Councilor Howison made a motion to approve the consent agenda with the minutes being corrected to identify the 9/11/08 resolution and the 9/11/08 budget.  Councilor Quandt seconded and after unanimous vote, the motion passed.

4.  Announcements / Correspondence  

A.  The Mayor announced Team Dunes City made $3200.00 for Relay for Life  

5.  Citizen Input on Unscheduled Items  

            Mrs. Judy Bedsole 484 Summit Ave  

            Mrs. Bedsole submitted letters of complaints regarding runoff and a retaining wall.  

            Mr. Ralph Farnsworth 83837 Hwy. 101  

            Mr. Farnsworth stated he came to talk about money.  He spoke of the current economy of the nation.  He spoke of bank ratings.  He suggested the re-activation        of a revenue committee to investigate making sure the City’s money is in the correct place.  

            Mr. John Stead 83505 South Cove Way  

            Mr. Stead spoke of the Tsiltcoos Lake Club Plat and the decision of whether or not   to acquire the roads.  He commended the Mayor for what he has done.  

            Mrs. Mary Jo Leach 84284 Alder Drive  

            Mrs. Leach said she listened to Mr. Farnsworth discuss the road funds at the Festival of the Lakes.  She expressed her concerns with roads that need work.  Mayor Hauptman said the City is looking into surveying the roads.  

6.  Reports  

A.  Mayor’s report from Mayor Hauptman – The Mayor spoke of Greengate Road and that at this time, the gate will not be locked.   

B.  Community Center/CCI report from Councilor Howison – Councilor Howison stated he did get an aluminum stepladder.  

C.  Conservation Committee report from Councilor Curran – Councilor Curran stated the report he submitted to the Planning Commission was not heard last month.  

D.  Parks and Recreation Committee report from Councilor Quandt – Councilor Quandt said they now have five members on the committee and they met for the first time to regroup and assess past projects.  They’ve made goals and have delegated research tasks.  

E.  Road Commission report from Councilor Petersdorf – Councilor Petersdorf was not present.  Councilor Navetta questioned if there were any roads minutes and after looking through their packets, the Council found none were submitted.  

F.  Site Review Committee / Grants / Police report from Councilor Navetta – Councilor Navetta submitted her report in writing.  She discussed the current issues she is investigating.  

G.  WCC / Communication & Education report from Councilor Koehler – Councilor Koehler read his report.  He stated there was a breach in security and that a radical group had hacked into the Dunes City website.  He said the Festival of Lights is coming up this December.  

H.  Planning Commission report from Planning Secretary, Lisa Ekelund – Lisa Ekelund read her planning report which was also submitted in writing.  

7.  Unfinished /Old Business  

            A.  Budgeted Road Work  

The Mayor asked for citizens to call the city to identify problem roads so they can be included with the report for bid.  Councilor Navetta submitted pictures of Wright Road and addressed concerns.  

            B.  Skeele / Atkeson – Ternyik Report  

Mayor Hauptman asked City Recorder, Amy Graham to give an update on this property.   

Amy Graham stated Mr. Ternyik submitted a letter that stated Mr. Atkeson cancelled the contract to do the delineation report.  On Oct. 1st, Mr. Ternyik called City Hall and spoke to Lisa Ekelund the Planning Secretary and stated Mr. Atkeson is willing to cooperate with the city and he would like to have Mr. Ternyik do the report.  Mr. Ternyik stated his attorney suggested he not do the report until issues are settled with Mr. Skeele.  

            C.  Greengate Rd.  

Mayor Hauptman said he discussed this update and nothing should be happening until the first of the year.           

            D.  Ocean Blvd.  

Mayor Hauptman said letters were sent stating the property in question needs to be returned to its original state.  He addressed the City Recorder who said letters addressing the timeline to complete the work will be going out Friday October 10, 2008 .  

The Mayor brought forth discussion of the parking issue.  Councilor Navetta said planning for visiting parking in all of Dunes City is pertinent.   

Councilor Howison noted the area on Ocean Blvd. is public.  He said the City needs to make sure any decisions made are fair without undermining water quality.  

Councilor Koehler said if mobile homes are parked in the riparian area, the area loses its viability and the Mayor said that is something to consider.  

Councilor Quandt stated this didn’t seem to be a problem until large livable vehicles were parked in the area.  He said if the City could go back to what it was before, it would be best for the neighborhood.  

Councilor Navetta said she thought it was time for a round table discussion and the Mayor agreed.  

Councilor Curran said there are parks for trailer homes and that they shouldn’t be allowed to park in front of homes.  

A time of October 23rd at 7:00 pm was set to have the Special Session of the City Council to discuss Ocean Blvd.  

8.  New Business  

            A.  Mr. Leach 5573 Woahink Drive appeal of Road Commission decision 

Mr. Leach from 84824 Alder Drive approached the Council.  He said he asked the road commission to remove poles from the middle of the road.  He said Councilor Petersdorf couldn’t back down from giving the permission to install the poles.  He said he and his neighbors are having trouble maneuvering around them.   

Councilor Navetta Mr. May's parents are in the process of cleaning it up.  

Councilor Howison asked if there was ever a decision from the road commission to approve the poles.  

            Mr. Leach said the poles have been there for approximately 6 years.  

Councilor Navetta stated she found no permits on record to install these poles.          

Councilor Koehler said he has no records to provide the public of past road commission minutes.  

Mayor Hauptman said the question is if Mr. May installed these poles with the impression he had permission  

Mr. Leach said Councilor Petersdorf said he gave Mr. May permission to install the poles and he couldn’t undo it.  

Councilor Howison said this should have been a City Council decision.  

Councilor Quandt said if there was a permit issued, it should have been a temporary right of use permit.  It is now a problem and they would have only been temporary so they should be removed.  

Councilor Curran made a motion to notify the owner of the property that the poles are in the public right of way of City property and they should be removed.   

Councilor Navetta seconded the motion.  

The council discussed a time limit for removal and it was suggested by City Recorder, Amy Graham that they allow 45 days for Mr. May to remove the poles.  

After unanimous vote, the motion passed.  

            B.  Response to Bob Petersdorf letter to the Council  

Mayor Hauptman said Councilor Petersdorf submitted documents in response to questions raised at the last City Council meeting.  

Councilor Quandt read his summary and findings of facts.  

Councilor Koehler asked for the council’s approval to post the information on the website.  

Councilor Navetta asked if the Road Commission members will receive this information as well.  She said according to the minutes, it has still not been made clear to the road commission as to who is allowed to approve permits.  

Councilor Quandt said he would attend the next Road Commission meeting.  

Mayor Hauptman clarified to the City Recorder that the Roads Secretary will add Councilor Quandt to the next Road Commission agenda.  

9.  Public Hearing  

            A.  1st reading of Ordinance 198  

            Mayor Hauptman read Ordinance 198 amending chapter 154 of the Dunes City code to revise the number of conservation committee members and staggering of terms, and to define a quorum.  

            Mayor Hauptman asked if there were any questions or comments from the council.  He then asked if there was any public comment.  

            The Council discussed the ordinance.  

            Councilor Quandt made the motion adopting ordinance 198 as written and Councilor Navetta seconded.  After unanimous vote, the motion passed.  

10.  Adjournment  

            Councilor Howison moved to adjourn and Councilor Quandt seconded.  After unanimous vote, the meeting adjourned 8:49 pm .
