There was confusion over the purpose of the meeting.  Judy Martin and John Scott were under the impression the meeting was a workshop with only the Council and the Planning Commission.  John Scott informed us that Judy would be running the meeting.  Judy said George Burke, Bob Petersdorf and Lee Reichel would not be attending.  However, within a few minutes they arrived without Bob Petersdorf.  After a brief dispute all four left the building.  After the meeting, John Hogervorst said. “Had it been a work session that I was organizing, I would have worked with the staff to make sure that:

1. The Mayor was there to preside over the meeting

2.  It was noticed in the paper

3. All Councilors were informed and present for the meeting”.

Johan went on to say he had not remembered that the MSC/CCI was having 3 meetings with the Council and the Planning Commission.

 

Johan Hogervorst opened the scheduled MSC/CCI meeting at 7:04 pm .

Those in attendance were Darlene and Marv Beckman, David Bellemore, Cynthia and Mark Chandler, Steve Chu, Gary Darnielle, Audrey and Ralph Farnsworth, Johan Hogervorst, Peter Howison, Richard Koehler, Susie Navetta, John Stead, and Teri Tinker.

1.  Ordinance 182 additions:

Gary Darnielle led off the discussion with the definitions on page 8.  John Stead wanted to start on page 1.

Page 9 – day nursery is defined on page 12 as kindergarten and on page 12 kindergarten is defined as day care.

Teri Tinker left.

Page 10 – family child care, same as above.

Page 12 – Limited land use decisions needs to be reviewed.

Page 13 – lot coverage needs to be changed to 40 %., Add impervious surfaces to Ordinance 155.2.0.140.

Page 18 - Residential Care Homes addition of “special conditions” needs to be revisited.

Page 19 - Shoreland area to return to the definitions.

Page 30 - All uses, add a permit for site review, PUD’s, slopes over 12 % by the planning commission.

Page 39 – Adding {No building within a PUD shall be less than one acre in size} will take care if the open space confusion on PUD’s}.  Peter said “it can’t be left to the Council interpetation”.  Darlene Beckman replied, “No sh-- Sherlock”.

Page 45 – revisit, structures in the setback areas.

Eliminate RV’s from the UBG and what about Manufactured Home Parks and Page 44?

Page 56 – Waters edge 12’ on Siltcoos Lake and 39.6 on Woahink Lake .

Page 57 – development in the shoreland.

Page 58 – remove all.

Page 59 – Excessive slopes must be engineered.

Page 62 – protection during construction (Erosion Control Ordinance) all runoff should stay on the property. Variances – safe harbor? Has been misstated.

Page 63 – fencing in the shoreland should be removed.  (C) review the list.

Page 64 – (A) (5) no fertilizers in the shoreland and prohibit activities.

Page 66 – protection of the riparian corridor (8’ path).

Page 69 – design standards, land use decisions should be limited to PUD’s, subdivisions, etc.   Type I, II, III, IV require site review permit.

Pages 98, 99, and 100 – Per-Application Conference.

Page 115 – Special Procedures Expedited Land Division - Quasi Judicial, applies to Partitions, Subdivisions, and Limited Land Use.

Page 115 and 116 – Site Analysis Map.

Page 119 – (C) Criteria for site evaluations section need to be studied, surrounding information and site review evaluation (Darlene Beckman and Cynthia Chandler)

Page 119, 120, and 121 – language from LCOG about 12% slopes.

Page 130 – (K) the percentage of proposed development that falls within the sensitive area.

Page 127 and 132 – slope over 16% needs to be engineered.

Page 137 – Conditional Use Permits.

Page 138 – revocation.

Page 143 – ( 3) (A) (g), Sensitive Area.

John Stead stated he had several concerns regarding the definitions and was given the task of editing the definitions and will bring those to us next Wednesday.

Item 2.  Gary Darnielle will try to bring Denise Kalakay to the next meeting.

Items to investigate are:

1. Safe Harbor

2.  PUD’s

3.  Master Road Plan

4.  Lot size

5.  Page 114 (site)

Item 3.  Final statements – No grading permit was issued to Rase before he disturbed the soil even though he asked about driveway access.  Susie Navetta stated that the Planning Commission had the understanding that Mike McCallister would be monitoring the property during road construction.

The next meeting of the MSC/CCI will be on November 8th at 6:00 pm to review the Phosphorus Ordinance and at 7:00 pm to resume the discussions on Ordinance 182.

The meeting adjourned at 10:23 pm .
