Conversation with LCOG concerning the MSC ordinance revision that is ongoing

Procedural Code Aspects - Gary asked Denise Walters to stop work on the procedural aspects of the code revision after he saw the proposed Ordinance 182 on the Council agenda. After the meeting he asked her to resume her work. She should be finishing a draft and making it available for Gary 's review by August 23rd. Soon after, the MSC will have it for review. This effort will also include a red-lined document with notes that direct the reader from crossed out paragraphs to locations in the new document where the item fits in. Denise Walters has been very responsive to my questions on the phone.

Erosion Control - Denise Kalakay has mostly been reviewing drafts that have come to her and has not had any problems with the verbiage that she has seen. I talked with Denise by phone this afternoon and she updated me on her work. She has worked 8-10 hours on the erosion control ordinance and is preparing something fun and educational for the festival this weekend. She will write an enforcement paragraph in the erosion control ordinance when we get her a final draft. She will also communicate with Mark Chandler about possible BMP reference manuals and find out what he already has. I mentioned that she should not hesitate to proactively lead on elements of this ordinance that may be missing so that we could strengthen it. She agreed to do this but said she hadn't seen anything that was missing to this point.

Storm Water Runoff- Tim Bingham and Mark Chandler have been having discourse about the scope of the ordinance. We originally decided to work on water quality aspects of storm water runoff and save water quantity for later efforts. There is some dispute as to what is entailed with water quality. Johan needs to speak with Tim and clarify what is included in the water quality portion of storm water runoff.

Timeline for public process:

1. Complete drafts of procedural code changes, storm water runoff, erosion control, new septic standards and phosphorus fertilizers by September 7th.

2. Prior to September 8th, notify DLCD of our progress with the priorities set forth in the original ordinance instating the moratorium. Due to the fact that proposed changes are not land use related; this is merely a courtesy.

3. Present the drafts at a working session, prior to the next Council meeting and propose a public process for review. The only comments to be taken are on the process for public review, not the ordinances themselves until_ public comment has been completed. The public process would include the following:

        Schedule 30-day public comment period to start on September 15"', Post drafts on website and publish request for public review in newspaper and at post office.

        Schedule a public meeting for October 18th to receive comments (advertise as working meeting to allow all Councilors to attend if desired).

        Ordinance Revision CCI / LCOG make appropriate changes in response to public comment by October 27th and post to Internet. Make a decision on whether another public meeting is needed to go over changes to draft.

        Possible second public meeting for comments November I st Also second builder / developer meeting if needed

        Present a final draft to the Planning Commission for review and comment on November 8th.

        Planning Commission review and compile recommendations to City Council at November 16th meeting.

        City Counselors consider public and Planning Commission feedback on revised ordinances at December 14th meeting, allowing for public comment at meeting.

        Draft a resolution for vote on appropriate code changes at the January 11th City Council meeting.
